Give Polish citizens right to appeal to constitutional court!

Opinion

Mr Jean-Paul COSTA
President of the European Court of human rights

Sire,
hereby I would like to inform You that Polish citiyens do not have a legal right to appeal to the constitutional court if they find some of the legal acts contradictiory with the constitution. In fact many are, if not most of the acts. Polish law has a fame of rather bad quality.

Only some intitutions can apply to the court, and interested citizens theoretically can apply via these institutions. However, these institutions work as censorship to prevent such usage of constitutional tribunal as in other contries based on constitutional demorcacy. I believe that You should put a pressure onto Polish authorites to change this situation. Besides, to apply to many important courts an assistance of barrister is necessary and obligatory. It rises the transaction costs of applying with questions to such courts.

In my opiniuon such a position of constitutional court, i.e. a situation where citisens do not have a legal right to petition it themselves, signifies that Polish system is not a constitutional democracy that gives rights to people but rather some transitory regime.
